AMENDED SUMMONS

THIS SUMMONS IS DIRECTED TO Leslie A. Lurken and Raegen Lurken, 26075 615th Street, Mantorville, MN 55955; Daryl K. Houston and Nancy J Houston26304 615th Street, Mantorville, MN 55955; Joel R. Radke and Kacey Radke, 26303 615th Street, Mantorville, MN 55955; and all other above named defendants by publication.

1. YOU ARE BEING SUED. The Plaintiffs have started a lawsuit against you. The Plaintiff’s Complaint against you is attached to this Summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons.

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at:

3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint.

5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Dodge County, State of Minnesota, legally described as follows:

That part of the Northeast Quarter of the Southwest Quarter of Section 23, Township 107 North, Range 16 West, Dodge County, Minnesota, described as follows:

Commencing at the Southeast corner of the Southwest Quarter of said Section 23; thence North 00 degrees 18 minutes 15 seconds East (NOTE: All bearings are in relationship with the Dodge County Coordinate System NAD ’83, Adjusted 1996) along the East line of said Southwest Quarter, 1327.39 feet to the Southeast corner of the Northeast Quarter of said Southwest Quarter; thence South 89 degrees 56 minutes 26 seconds West, along the South line of said Northeast Quarter of the Southwest Quarter, 690.23 feet to the POINT OF BEGINNING; thence North 00 degrees 23 minutes 29 seconds East, parallel with the West line of said Northeast Quarter of the Southwest Quarter, 940.69 feet to the centerline of County Road Number 15; thence South 58 degrees 34 minutes 13 seconds West, along said centerline, 267.49 feet; thence Southwesterly 424.75 feet along a tangential curve concave Northwesterly, having a central angle of 25 degrees 34 minutes 43 seconds, and a radius of 951.44 feet to the West line of said Northeast Quarter of the Southwest Quarter; thence South 00 degrees 23 minutes 29 seconds West, along said West line, 5.33 feet to the North line of the South 7.5 acres of the West 15 acres of said Northeast Quarter of the Southwest Quarter; thence North 89 degrees 51 minutes 33 seconds East, along said North line, 443.52 feet to the West line of property described in Document Number 116893; thence South 00 degrees 23 minutes 29 seconds West, along said West line of property, 658.49 feet; thence South 18 degrees 50 minutes 21 seconds East, 4.25 feet to the South line of said Northeast Quarter of the Southwest Quarter; thence North 89 degrees 56 minutes 26 seconds East along said South line, 180.60 feet to the POINT OF BEGINNING.

Said parcel contains 4.36 acres more or less, including 0.76 acres of Right of Way.

Said parcel is subject to Dodge County Road No. 15 Right of Way easement along the Northerly side thereof and is subject to any other easements or encumbrances of record.

Said parcel contains 18.06 acres more or less, including 1.25 acres of Right of Way.

Said parcel is subject to Dodge County Road No. 15 Right of Way easement along the Northerly side thereof and is subject to any other easements or encumbrances of record.

The object of this action is to quiet title to the above described real property.
